General Data Protection Regulations

As you might be aware the General Data Protection Regulations come into force for all member states of the European Union on 25 May 2018. This legislation will be unaffected by Brexit in real terms where the UK's Data Protection Bill will incorporate the same provisions once Brexit has run its course.

 

On considering matters it is the intention of McKenzies (NI) Limited to comply with the 6 Data Protection Principles insofar that:-

  2. Any use of personal data will be limited to its purpose ie any data obtained will be for specified, explicit or legitimate purposes only;
  3. Any use of personal data will be minimised to matters which are adequate, relevant and necessary;

  5. Any personal data held will be kept no longer than is necessary;
  6. McKenzies (NI) Limited will exercise integrity and confidentiality when using or retaining any personal data, taking appropriate security measures where necessary against unlawful processing, damage or destruction.

 

On considering matters, we write to inform you that McKenzies (NI) Limited will be processing and controlling personal data in relation to its staff and its customers as:-

 

  1. this is necessary for the performance of a contract; and/or
  2. because there is a legitimate business interest for McKenzies (NI) Limited in respect of the relationship which it has with its staff and its customers.

 

On considering these matters you are asked to note that McKenzies (NI) Limited would be unable to perform its contracts with its customers, pay its staff, enter into appropriate correspondence and/or comply with the requirements of HMRC and the Equality Commission if it was unable to process personal data relating to its staff and customers.

Any personal data held about individuals or customers will be held for no longer than 3 years following the period of employment or any contract entered into with McKenzies (NI) Limited, whichever is the latest in time.

 

In the event any customer or employee is unhappy about the controlling or processing of personal data they have a right to complain to the Information Commissioner's Office. Any breach of the General Data Protection Regulations will be reported by McKenzies (NI) Limited to the Information Commissioner' Office within 72 hours in accordance with the minimum requirements.

 

McKenzies (NI) Limited will continue to review its procedures to ensure compliance with the General Data Protection Regulations at all times.  McKenzies (NI) LImited will additionally carry out regular Data Protection/Privacy Impact Assessments in circumstances where it uses CCTV footage and other systems for the purposes of security.
